Terms of use for the Victorinox Community

Terms of use
By using the Victorinox Community platform (the “Victorinox Community” or “Community”), users agree to the following terms of use as members of the Victorinox Community (the “Member” or “you”).
Scope
These terms of use apply to the Victorinox Community. Victorinox may amend or supplement them at any time at its sole discretion. The version valid at the time of use shall apply. Each Member is required to periodically review this page for updates to the terms of use. By continuing to use the Victorinox Community after such changes are published, you accept the revised terms.
The Victorinox Community is owned by Victorinox, i.e. Victorinox AG, Schmiedgasse 57, CH-6438 Ibach-Schwyz (Switzerland). The platform is operated by Glowing Blue AG, Eigerstrasse 12, CH-3007 Bern (Switzerland), on behalf of Victorinox. Glowing Blue AG acts as a data processor and may access your data as necessary to operate the Victorinox Community. This includes profile and contact information, user history (e.g. logins), content, and communications. The data made available to Glowing Blue remains in Switzerland and is subject to the Swiss Federal Data Protection Act and, where applicable, the GDPR, under a corresponding data processing agreement.
Additional conditions may apply to specific features, competitions, events or the Victorinox online shop.
Community Offering
The Victorinox Community is intended for Members to exchange views about Victorinox products. The Community and its services and features are provided to Members of Victorinox Community free of charge within the scope of and based on these terms of use.
Where technically enabled, Members can post content, participate in discussions, upload images (jpg/png), submit product reviews, engage in Community activities, or connect with others. However, we do not assume any further obligations.
Victorinox reserves the right, at its sole discretion and without notice, to restrict or revoke access to certain features or the entire Community, delete content, or ban Members — particularly when their behavior conflicts with the Community’s purpose or these terms.
Members are not guaranteed constant access to the Victorinox Community or its services and features. Services and functions may be interrupted for scheduled or unscheduled reasons. We do not accept any liability for interruptions, delays, failures or loss of data. Victorinox may modify, suspend or discontinue the Victorinox Community as a whole or individual services and functions of the Victorinox Community at its own discretion, either temporarily or permanently. If the Victorinox Community as a whole or an individual services or feature is discontinued, this will be communicated at least four weeks in advance via the Victorinox Community and/or directly to the Members.
In connection with the Community Victorinox may also:
Log IP addresses to verify Member identities,
Contact Members in exceptional cases,
Temporarily or permanently suspend Members violating the terms,
Use anonymized usage data for statistical purposes.
Registration and General Rules
The Victorinox Community may only be used by natural persons for personal, private purposes. Commercial use, as well as the direct or indirect offering, purchase, or sale of goods or services of any kind via the Victorinox Community, is not permitted. In particular, using the Community for personal or third-party advertising purposes is strictly prohibited. By using the Victorinox Community, Members confirm that they are at least 18 years old, or at least 16 years old and acting with the express consent of their legal guardians.
Members undertake to comply with appropriate security standards when using the Victorinox Community and to take appropriate data security measures. The introduction and distribution of computer viruses, trojans and other harmful programs is strictly prohibited and must be prevented by appropriate security measures.
To register, the Member must provide a username, surname, first name, country of residence, language, a password and a current, functioning e-mail address. Only e-mail addresses that can be clearly assigned to the Member will be accepted. This data is stored and used in accordance with Victorinox's data protection provisions (Section 10).
In the event of changes to the e-mail address or other user data, the Member is obliged to update this in the Victorinox Community immediately. If the Member fails to fulfil this obligation, he/she shall bear all resulting disadvantages.
After successful registration, the Member receives a password-protected Victorinox Community User Account (“User Account”). The User Account gives the Member access to the services and functions of the Victorinox Community.
There is no right to be activated or participate in the community. This decision is entirely at the discretion of Victorinox. We are not obliged to justify why (future) users or Members of the Victorinox Community may be excluded or denied access.
The User Account may only be used by the Member themself. The Member undertakes to protect access to the services of the Victorinox Community against unauthorized use by third parties. The access data, in particular the password, may not be shared. The Member is liable for any unauthorized use of the access data made possible by their behavior and the associated use of the services of the Victorinox Community. The Member assumes responsibility for all activities that take place under their Victorinox Community User Account. If the Member becomes aware that their access data is being used without authorization by third parties, the password must be changed immediately. If this is not possible, Victorinox must be informed immediately.
Each Member is solely responsible for all interactions with other Members of the Victorinox Community. Victorinox is not responsible for interactions between Members or for their actions. Victorinox entitled, but not obliged, to monitor potential conflicts between Members.
Use of the Collection Function
Each Member can use the "Collection" feature after completing registration. It is also possible to create multiple collections. Collections and their contents are visible to other Members of the Victorinox Community, unless the Member marks them as "private."
Section 5 applies accordingly to the content within the Collection feature.
Posting Contributions
As a registered Member, you may post your own contributions, such as reviews, articles, comments, or discussion posts. Contributions must be in line with the purpose of the community and comply with these terms of use. Every Member must observe applicable laws and respect the rights of third parties.
In particular, each Member agrees not to publish any content that:
Is criminal (e.g. offensive, obscene, pornographic, threatening, inciting violence, discriminatory, racist, defamatory, misleading, or illegal);
Infringes the rights of third parties (including copyrights, trademarks, patent rights, or personal rights);
Contains unobjective or false statements;
Originates from banned organizations;
Constitutes commercial advertising or spam;
Serves as a political campaign;
Contains direct or indirect advertising for third-party products;
Otherwise contains harmful content;
Damages the reputation of Victorinox or its products.
Furthermore, every Member agrees to the following when posting content:
It is prohibited to carry out actions that impair the proper functioning of a social media channel, particularly the Victorinox Community, or to upload files that contain harmful viruses or similar threats;
Content may only be uploaded if the Member holds the necessary rights;
Where required, sources of third-party content must be cited. Proper source attributions must not be falsified or removed;
Victorinox’s copyrights, trademarks (e.g., our logo), or other intellectual property may only be used with written permission;
Content shared directly with Victorinox or another Member may not be used or reproduced in the Victorinox Community or elsewhere without written consent from the individuals involved.
Members may only post their own content, especially texts and photos. The content must not infringe the rights of third parties, particularly under copyright law, the right to one’s own image, or general personality rights. Uploading content is only permitted if the Member is the creator or has been granted the relevant usage rights. By uploading content, the Member guarantees that they are authorized to do so. If quoting content from third parties is permitted, the source must be correctly and fully cited. Section 7 applies additionally.
By posting a contribution in the Victorinox Community, the Member grants Victorinox a free, irrevocable, sublicensable, unlimited license in terms of time and geography to use, reproduce, publish, perform, translate, create derivative works, duplicate, and display the content across all media — especially on all channels and stores, in the web shop, on social media platforms of Victorinox, and in print media. Victorinox may also edit, shorten, or modify the content, anonymize individuals for privacy reasons, and combine content with other materials, including advertising. Victorinox is not obligated to credit the author.
We expressly reserve the right to delete individual contributions at any time and at our sole discretion, without providing reasons, whether they violate legal regulations or these terms of use. There is no entitlement to have content published. In cases of serious abuse or violations, we may take additional legal action.
You must refrain from any actions that may impair, damage, or destroy the hardware, software, or performance of another computer or our service servers. In particular, it is forbidden to post content containing viruses, send or forward mass emails ("spam") or chain letters, or otherwise overload the Victorinox Community or Victorinox websites.
Personal data of other Members, particularly names and email addresses, may only be used for communication within or in connection with the Victorinox Community. You may not send unsolicited emails unless the recipient has explicitly consented. Chain letters, spam, or promotional emails are prohibited. You may not add contact information of other Members to mailing lists without their prior express consent.
Responsibility and Indemnification
We assume no responsibility or liability for Member-posted content in the Victorinox Community. Responsibility for publication and content lies solely with the respective Member. The views and opinions expressed by community Members are solely their own and not those of Victorinox — even if the Member is an employee or associate of Victorinox.
We do not monitor Member posts or collections. However, if we become aware of any content that violates these terms, we reserve the right to delete it and/or exclude the Member from the platform and take further legal steps if necessary.
If a Member feels their rights have been violated by another Member’s content, they may contact Victorinox (see Section 11) and request the removal of such content. This decision rests, however, solely with Victorinox. Further claims and any liability of Victorinox in this context are excluded.
Each Member agrees to indemnify Victorinox and its employees, bodies, and representatives from any liability, obligations, costs, or claims upon first request. This applies to posted content, use of services, breaches of the terms, or violations of third-party rights.
The Member must reimburse Victorinox for any related costs, including reasonable legal fees. Victorinox may not enter into settlements without the affected Member’s consent.
Liability
Victorinox does neither guarantee that posts are up to date at all times nor the accuracy or completeness date of content posted on the Victorinox Community. We also assume no responsibility for third-party websites accessed via external links.
To the extent permitted by law, we exclude all liability for losses or damages (direct or indirect) incurred by Members or third parties in connection with accessing or using the Victorinox Community.
Members are responsible for providing the necessary technical requirements to use the services (e.g. browsers, internet access) at their own expense. We do not guarantee compatibility with the hardware or software used.
Victorinox is not liable for any damage caused by service interruptions, especially data loss. There is no claim for data recovery.
Responsibility for Member-posted content lies exclusively with the respective Members. Victorinox assumes no liability.
Content shared via direct links may be accessed and redistributed by third parties without your knowledge or consent — even if marked private or shared in private messages. Unlisted links are not indexed but are accessible by anyone who has the link. Victorinox is not liable for unauthorized access, copying, or distribution of such content.
Advertising Integration
Victorinox is authorized to place advertising banners or other forms of advertising on all websites of the Victorinox Community itself or through an external service provider. The Member agrees that the advertising may also be placed on the pages containing his collection(s) or the content or contributions uploaded by him.
Advertising banners or other forms of advertising placed by Victorinox may not be hidden or obscured by technical devices or replaced by other content, in particular own advertising content.
The placement of advertising banners by the Member or third parties authorized by the Member in a collection or in the Member's contributions is not permitted.
If the Member registers with a User Account in the Victorinox Community, this also constitutes registration for the Victorinox newsletter. The Members’ e-mail address will be used to periodically provide information on topics related to Victorinox, e.g. current offers, activities and competitions. You can unsubscribe from the newsletter at any time by sending an e-mail to community.hq@victorinox.com or directly in the newsletter. Further information on the newsletter can be found in the privacy policy published on the Victorinox website.
Deleting the Victorinox Community User Account
Every Member can request the deactivation of their User Account with subsequent deletion or anonymization at any time via community.hq@victorinox.com. In addition to the User Account, the request must also include the full name of the user.
Each Member may only request the deactivation of their own Victorinox Community User Account. The request for deactivation requires that the respective Member has an active User Account.
The deactivation and deletion of the User Account shall be carried out by Victorinox. Within four (4) working days, the Member will receive confirmation that the deactivation will be carried out and that the User Account of the respective Member will be permanently deleted within four (4) working days of this confirmation. We expressly reserve the right to examine the request for deactivation and deletion in more detail in individual cases and to contact the Member if necessary.
If a Member deactivates their User Account, it will be deleted, and all personal user data anonymized. All public posts by this Member remain in the Victorinox Community system and are assigned to the ‘former user’ or ‘former Member’ group or a comparable category. They can still be read by the other Members.
It is not possible to restore a previous Victorinox Community User Account after it has been deleted.
Confidentiality and data protection
There is no monitoring of Members' contributions or collections.
By registering and participating in the Victorinox Community, you consent to the collection, storage and use of your personal data in accordance with the applicable Swiss and European data protection regulations. You can revoke your consent to the collection, storage and use of personal data at any time by contacting Victorinox. Under certain circumstances, this may result in an exclusion from the Victorinox Community. Further information on this can be found in the privacy policy.
Victorinox may be required by law or legal process to disclose your personal data. Disclosures to authorities are only made within the framework of mandatory legal provisions.

Final provisions
These Terms of Use may be amended at any time.
These Terms of Use are supplemented by the General Terms and Conditions. In case of contradictions, these Terms of Use shall take precedence.
Swiss law applies in case of discrepancies and disputes in connection with the Victorinox Community. The place of jurisdiction is Schwyz (Switzerland). Laws on international purchases of movable goods (UN Convention on Contracts for the International Sale of Goods / CISG) are expressly excluded.
If any provision becomes invalid, the remaining provisions will still be effective.
